Nirvana’s Nevermind cover is one of the most famous covers in the music industry.
The famous image shows a naked baby swimming in a pool chasing a one-dollar bill.
Everyone who knows a little bit about music has seen the image.
As it also is one of Nirvana’s most popular albums.
Well, right now that baby is more than 30 years old and is Stephen Elden.
Elden, who appears in the photograph as a baby,
Has used the picture several times to show that he was the baby.
He has recreated the picture several times,
On different anniversaries of the album.
Moreover, Elden has also a tattoo of the famous album title on his chest.
Still, he has said in interviews that he had mixed feelings about the image…
The child pornography laws have changed a lot in the last few years,
Especially with the exponential growth of the internet.
However, back in the 90s when the album came out with its original cover
The use of non-sexualized nude pictures of children was not considered
As child pornography in the U.S.
In fact, that law is still applying today.
Right now, just a couple of hours ago, his lawyer announced that
They will be suing the band for child pornography.
Alleging that the band had exploited the image since Elden was a baby,
And he has dealt with the consequences of being tied to that picture.
Variety had access to the lawsuit, which reads thus:
"Defendants intentionally commercially marketed Spencer's child pornography and leveraged the shocking nature of his image to promote themselves and their music at his expense.”
Elden is currently suing the members of the band for $150,000 in damages.
Representatives from Nirvana have not spoken yet about the news.
